Right of Withdrawal

As a consumer entering into a distance contract, you have a statutory right of withdrawal. This page describes it, explains what happens if you use it, and contains the form for doing so. It forms part of our Terms and Conditions.

You have the right to withdraw from this contract within fourteen days without giving any reason.
The withdrawal period is fourteen days from the day the contract was concluded.

— by means of a clear statement (for example a letter sent by post, or an email) of your decision to withdraw from this contract. You may use the model withdrawal form below, but it is not obligatory.
To meet the withdrawal deadline, it is sufficient that you send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.
Effects of withdrawal
If you withdraw from this contract, we shall reimburse all payments received from you without undue delay and in any event no later than fourteen days from the day on which we are informed about your decision to withdraw.
We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise. In no event will you be charged any fees as a result of such reimbursement.
If you requested that the service begin during the withdrawal period, you shall pay us an amount which is in proportion to what has been provided until you communicated your withdrawal, in comparison with the full coverage of the contract.
What this means in practice
A game server is a continuously supplied service. Your right of withdrawal therefore does not lapse because we provision the server immediately — it simply converts into a pro-rata settlement.
Example: you take a server at €12 per month and withdraw on day 5. We keep the 5 days the server was available to you (€12 × 5/30 = €2) and refund the remaining €10.
Because our servers are provisioned immediately at your express request, you confirm at the point of ordering that you want us to begin before the withdrawal period expires, and that you will owe the pro-rata amount if you withdraw.

When the right of withdrawal does not apply
- Free servers. The statutory right of withdrawal presupposes a contract for consideration. It does not exist for servers from our test or beta phase — but you can end those informally at any time anyway.
- Business customers. The right of withdrawal is available to consumers only. If you enter into the contract in the course of your trade or profession, the termination rules in the Terms and Conditions apply instead.
Voluntary 7-day satisfaction guarantee
In addition to your statutory right of withdrawal — and without limiting it — we voluntarily offer the following:
If you are dissatisfied for technical reasons within the first 7 days after provisioning (for example instability or performance problems we cannot resolve), we refund the full amount with no pro-rata deduction.
This is a goodwill arrangement, not a statutory entitlement. Within the first 7 days it is better for you than statutory withdrawal, because nothing is retained; the statutory right of withdrawal, however, runs the full 14 days and you can rely on it at any time. We automatically apply whichever is more favourable to you.
Unused credit
Credit on your account is a prepayment, not a fee for a service already rendered. Therefore, independently of any right of withdrawal:
- Credit does not expire and has no end date.
- You can have unused credit paid out at any time — without giving a reason, even years later, even if you no longer have a server at all.
- Just write to support@mcbalkan.xyz. We refund by the same route you topped up, and we deduct nothing.
Credit already consumed — that is, for periods in which your server was available — is not refunded, except in the context of a withdrawal or the satisfaction guarantee.
What happens to your data
If you withdraw or use the guarantee, the server is powered off. Your data is retained for 7 days so you can back it up, and is deleted after that. Let us know if you need more time.
